Illinois SB 3129: What HR Teams Need to Know in 2026

ILLINOIS SB 3129 Effective January 1, 2025 15+ employees • $500–$10,000 fines

Illinois SB 3129 took effect January 1, 2025, requiring salary range disclosure in all job postings for employers with 15 or more employees. As of early 2026, the Illinois Department of Labor (IDOL) has published enforcement FAQ clarifying key aspects — including that remote roles accessible to Illinois residents are fully covered.

Core requirements

All job postings must include the pay scale and benefits information. The IDOL defines "pay scale" as the salary range or hourly rate range the employer in good faith expects to pay. Benefits disclosure is required but less prescriptive than Colorado or Washington.

"The IDOL's January 2026 FAQ settled a key question: if a remote role is open to Illinois residents, SB 3129 applies regardless of where the employer is based."

Enforcement update

Fines run from $500 for a first violation to $10,000 for repeat offences. IDOL is actively investigating complaints filed since the law took effect. Out-of-state employers posting remote roles accessible to Illinois residents are now a specific enforcement focus.
